These Terms and Conditions (“Terms”) govern your use of services provided by MGI Restorations (“Company,” “we,” “our,” “us”). By requesting, booking, or receiving our services, you agree to be bound by these Terms.
1. Services Provided
MGI Restorations specializes in residential and commercial construction, remodeling, and restoration services. All work is performed pursuant to written proposals, estimates, or contracts issued by us.
2. Estimates & Payment
- Estimates are valid for 30 days unless otherwise stated.
- A deposit may be required prior to commencement of work. Final payment is due upon substantial completion, unless otherwise outlined in your service agreement.
- We reserve the right to stop work or withhold delivery of materials until payments are made as agreed.
3. Changes & Cancellations
- Changes to the scope of work must be agreed to in writing. Additional charges may apply.
- If you cancel a project after work has commenced, you may be responsible for labor, materials, and other costs incurred up to the cancellation date.
- All approved change orders must be paid in full at the time of the written change and are not eligible for payment plans.
4. Warranties & Disclaimers
- MGI Restorations warrants its workmanship for one year from completion, unless otherwise specified.
- We make no warranties for defects caused by misuse, lack of maintenance, modifications by others, or circumstances beyond our control.
- Except as expressly provided, services are offered “as is” and we disclaim all other warranties, express or implied, including merchantability or fitness for a particular purpose.
5. Limitation of Liability
- To the maximum extent permitted by law, MGI Restorations shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, use, or data.
- Our total liability for any claim shall not exceed the amount paid by you for the specific project giving rise to the claim.
- We are not responsible for delays or damages caused by factors outside our control (e.g., weather, supply shortages, permitting, labor strikes, acts of God).
6. Intellectual Property
- All designs, drawings, proposals, and project materials created by MGI Restorations remain our intellectual property unless otherwise agreed in writing.
- Clients may not reproduce, distribute, or use such materials for purposes other than the contracted project without our prior written consent.
7. User Responsibilities
By engaging our services, you agree to:
- Provide accurate information regarding property conditions and project requirements.
- Ensure necessary permits, approvals, and property access are available, unless otherwise stated in writing.
- Not misuse or misrepresent our content, name, logos, or project photos without written permission.
8. Privacy & Communication
• By submitting contact information, you consent to receive calls, emails, and text messages related to your inquiry or project.
• Mobile messaging opt-in data and consent will not be shared with third parties for marketing purposes.
• You may opt out of messages at any time by replying STOP or contacting us.
• For help, reply HELP or contact us directly.
• All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
9. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Florida.
- Any disputes shall be resolved exclusively in the state or federal courts of Orange County, Florida.
- Before pursuing litigation, both parties agree to attempt resolution through mediation or binding arbitration in Orange County, Florida.
10. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
11. Updates to Terms
We may revise these Terms at any time. The updated version will be posted on our website with a new “Last Updated” date. Continued use of our services constitutes acceptance of the updated Terms.
